Terms of use chatbot
Please read the general terms and conditions of use (hereafter GTCU) associated with the use of the chatbot before you start, as your interaction with our virtual assistant implies acceptance of these terms and conditions.
1. preamble
The chatbot that is the subject of these General Terms and Conditions of Use (hereinafter GTCU) is based on the ChatGPT technology developed by Open AI and was developed by the company EDSI-Tech Sàrl, which can be contacted at the following address: contact@edsi-tech.com. The TOU govern the use of the chatbot by the customer and the user. These TOU may be amended at any time. The customer will be informed of any changes as soon as possible. By using and providing the chatbot on the customer’s platform, it is assumed that the customer and user have taken note of and accepted the TOU.
2. terms
- Chatbot: Service tool developed by the Publisher on the basis of ChatGPT technology and made available on the Customer’s platform.
- Publisher: the company EDSI Tech Sàrl, based in Lausanne.
- Customer: natural person or legal entity that makes the chatbot available to its users, in this case Bad Schinznach AG.
- User: natural person who uses the chatbot.
- Services: Information, tips and advice provided by the chatbot.
3. use of the chatbot
The chatbot is based on the artificial intelligence of the company OpenAI. It has been trained with region-specific tourism data. The chatbot is constantly learning in order to improve its services. The services provided by the chatbot are for information purposes only and do not replace advice from a specialist. It is strongly recommended to check the information directly with the respective service providers, in particular with regard to opening hours, availability, access conditions, tariffs or accommodation options. Any use of the chatbot that violates the applicable legal provisions or applicable law is prohibited. In particular, it is prohibited to attempt to interfere with the chatbot or the services in any way that damages, alters or overloads the chatbot. The user undertakes not to cause any damage to the publisher of the chatbot by using the services or in any other way.
4. third party content
Content originating from third parties or third-party websites is reproduced for information purposes only. The use of third-party services or websites is subject to their terms of use. Under no circumstances can the publisher of the chatbot be held responsible for content displayed by third parties and originating from them, or for links leading to third-party content. The publisher is in no way liable for third-party content that is taken over by the user and made available to him.
5. liability
The services provided by the chatbot are for information purposes only and are non-binding. The information provided is not equivalent to advice from a specialist. The Publisher and the Client disclaim any liability in connection with the chatbot, in particular with regard to the content of the services provided by the chatbot or actions taken on the basis of the information provided. In particular, the Publisher and the Customer do not guarantee the accuracy, content or completeness of the information displayed, its truthfulness or timeliness. The chatbot and its services are available in principle and are available to the Customer and the Users. However, the publisher does not guarantee the availability of the chatbot or the services. The Publisher shall not be liable in any way for any interruption of access, overloading of the chatbot or the network, closure of the chatbot or for damages of any kind resulting therefrom. In particular, technical problems or maintenance work may result in an interruption of access or suspension of the services provided, for which the Publisher shall not be liable to pay any compensation. The publisher is in no way liable in the event of force majeure.
6 Intellectual property
The chatbot and the databases it contains are the exclusive property of the publisher.
Any use, duplication, copying or provision of the chatbot or the services by third parties is expressly prohibited without the permission of the publisher.
7 Legal information
The conversations conducted with the chatbot can be collected in order to improve its functionality and provide the services. By using the chatbot, the user consents to the collection and processing of the data transmitted by him. In addition to this data, the chatbot may process the following technical data:
- IP address
- Date and time of the request
- Time zone differences to GMT
- Content of the requests
- Access status / status code http
- Transmitted data volume
- Online platform from which the request originates
Unless the Issuer has made special agreements, the User and the Customer shall be bound by the terms and conditions of these GTU. In the event of a clause of these GTU being deemed void, unenforceable or invalid, the Issuer, the Customer and the User declare the remainder of the GTU to be fully applicable. Ineffective or invalid clauses shall be replaced by one or more legally valid provisions that come as close as possible to the content of these clauses. The invalidity and/or incompleteness of a provision shall not affect the validity of the remaining provisions. The publisher reserves the right to unilaterally and without prior notice change the third-party content provided via the chatbot as well as a user’s access to the chatbot.
